GENERAL TERMS OF USE

By accessing, browsing and/or using this site, you acknowledge that you have read, understood and agree to be bound by these regulations and to comply with all applicable laws and regulations. If you do not agree to these terms, then please do not use this site. We reserve the right to change the terms and conditions under which the website and the products are provided. Any such change in terms and conditions will be effective once included in the text of these terms and conditions and published on the website. We recommend that you check the terms and conditions posted on the website regularly to ensure that you are aware of any updates.

ORDERING

When placing an order you agree that all information provided is accurate and complete.

When you place your order over the website we will send a confirmation email which will detail the products ordered, payment method, and cost (including VAT and P&P) You must check that all the details on this confirmation email are correct and contact us as soon as possible if any details are incorrect.

Please note that your order constitutes only an offer to purchase goods from us, and does not form a binding contract until accepted by us. No contract for the sale of any product will exist between you and SportsShoes.com until we accept your order by despatching the product to you, notwithstanding that we may have sent an email confirmation.

We reserve the right not to accept any order. If your order has not been accepted, we will contact you to advise the reason why.

PAYMENT

We must receive full payment of the price of the goods before we can accept any order. Where you select to pay by credit or debit card we will process your payment at the time of preparing your goods for dispatch.

We take payment from your card at the time we despatch your order, once your card details have been validated.

All credit and debit cardholders are subject to validation checks and authorisation by their card issuer.

If the issuer of your payment card refuses to authorise payment to us, we will not be liable for any delay or non-delivery.

In the case of payment by cheque, we will not dispatch your order until 10 working days from the date of receipt of your order, and after the cheque has cleared.

Any discounts triggered by the entry of a promotional code will not be applied until the order is accepted and your payment card is charged. Discount codes may only be applied to purchases made through the account in respect of which the discount code was offered and registered.

For payments by bank transfer, orders will be despatched within one working day of receipt of payment. For express deliveries, please ensure that payment is made by 15:00 GMT to ensure same day despatch. Please note that payment must be received within 5 days of your order being placed. Thereafter, if no payment is received, your order will be cancelled.

KLARNA

PRICING

All prices are displayed on our website in UK pounds sterling and are inclusive of VAT where applicable.

We reserve the right to adjust prices and offers at our discretion at any time before (but not after) we accept your order.

We do our best to make sure that prices are correctly shown but very occasionally an error may occur. If this should happen, we will correct the price and ask you to confirm whether you still wish to purchase the goods at the correct price. If we are unable to contact you, we will at our discretion treat the order as cancelled. We will not be obliged to supply goods at the incorrect price.

STOCK

Goods are subject to availability. Our site automatically updates each time an item is sold, however in the rare event that your item is sold out we will contact you as soon as possible.

Availability information for products is listed on each individual product description. Where we are awaiting delivery of your item, we will not charge your credit or debit card until the items are back in stock and ready to be despatched.

All sizes and measurements are approximate and intended as a guide, although we do make every effort to ensure they are as accurate as possible.

We will take all reasonable care to ensure that all details, descriptions and prices of products appearing on the website are correct at the time they are published on the site. We reserve the right to refuse orders where product information has been published incorrectly, including prices and promotions.

All product images are as accurate as possible, however, due to a number of different factors such as internet browsers, monitor colour contrasts etc, we cannot be held responsible or liable for any differences in colour between the image and the actual product.

We reserve the right to withdraw products from sale at our discretion, at any time without notice.

PROMOTIONS

These promotion general terms and conditions apply to each and every promotion and in addition, all instructions, rules and conditions relating to a specific promotion form part of these general promotion terms and conditions.

Please refer to the specific terms and conditions relating to each promotion.

We reserve the right at any time, at our sole discretion and without notice to end, suspend, amend or add additional terms and conditions to any promotion.

You may not use more than one promotion per order and promotions may not be used in conjunction with one another unless otherwise specified by us. This includes affiliate promotions or in association with cashback sites.

CANCELLATIONS

Where applicable, you can cancel your order in accordance with your rights under certain regulations, commonly referred to as the "Distance Selling Regulations". This statutory right allows you to tell us that you wish to cancel your contract with us and receive a refund if you change your mind about the products you have purchased from us. This is often referred to as a "cooling off right".

At SportsShoes, we want you to be completely satisfied with your purchase so we offer an enhanced period of time in which you can cancel the contract and in most cases, we will allow you to change your mind within 100 days of receiving your goods. There are some exceptions to this however.

You can also use the cancellation form which appears at the end of these terms if you wish to cancel although you do not have to use that form if you don't wish to do so.

To cancel your order prior to product despatch we advise that you contact us by telephone as soon as possible after ordering as this will be a quicker way of us dealing with the cancellation and stopping the product being shipped.

For orders cancelled after despatch, you must tell us that you wish to cancel as explained above and then follow our returns procedure as explained below.

You are responsible for return postage costs which you will pay in sending the goods back to us.

Please note that these cancellation rights do not affect your rights in respect of something which we may do wrong, for example if we supply defective goods or fail to delivery the goods to you.

DELIVERY

Delivery periods are as stated in the Delivery Section. We are not responsible for any delays which occur whilst your goods are in transit with courier.

In the case of a missing or delayed parcel, we will attempt to locate the parcel in accordance with the procedures set out in the Delivery Section. In the event that we are unable to locate your parcel, replacements will be sent.

You must complete a Lossage Form before replacements for missing items can be sent. We will ensure this is emailed to you immediately.

EU International orders: All taxes and duties are included in the price for any order shipped to mainland EU (Including Ireland).

Non EU International orders: For the purposes of the contract, the customer is the importer of record for goods and as such takes on responsibility for payment of VAT and import duties. Please note that Sportsshoes.com pays all import and VAT duties on your behalf when despatching your order. However, in the event of any underpayment in import and VAT duties, it is your overall responsibility to ensure any additional payment is made.

RETURNS

You may return your order for an exchange or refund within the cancellation period explained above provided the goods are returned in a resaleable condition and not damaged as a result of you handling them. If the goods are returned to us in a damaged state, we reserve the right to deduct an appropriate amount from any amount we are to refund to you. Once you decide to return the goods you must not use them and must take reasonable care of them while they remain in your possession. The goods must be returned to us intact and undamaged as soon as reasonably possible, and within 100 days of you receiving them.

For health and hygiene reasons, we are unable to accept the return of underwear and swimwear that has been worn.

It is your responsibility to pay the postage costs for any items returned to us. We advise that you use a recorded method of carriage for returning your goods. We are not responsible for items lost or delayed on their way back to us unless you have a proof of postage. In the event of a lost parcel, you as the sender are responsible for processing a claim.

In the case of faulty goods, or goods which have been sent incorrectly, we will refund your reasonable return postage costs.

REFUNDS

All refunds will be processed via your original method of payment for the price of the goods. This excludes cash and postal orders where we will refund you by cheque.

Please allow 7 working days for your refund to be processed.

GENERAL PROMOTIONAL & COMPETITION TERMS AND CONDITIONS

  1. Acceptance of these terms and conditions is a condition of entry into any SportsShoes.com promotion or competition, and the entry instructions form part of these terms and conditions. By entering the promotion or competition you agree to be legally bound by these terms and conditions. The Promoters reserve the right, at their discretion, to exclude entrants and/or the winner if he/she does not comply with any of these terms and conditions.
  2. Competitions and promotions are open to adults aged 18 and above excluding employees of the Promoters, their families, agencies and anyone to whom they are professionally connected. Proof of age may be required.
  3. Winners will be selected by the Promoters from all correctly completed and submitted entries
  4. If a winner cannot be contacted, fails to confirm acceptance of the prize within the following 3 days of the announcement or cannot make use of the prize for any reason, the Promoters reserve the right to select an alternative winner or withdraw the prize and that winner will forfeit the prize.
  5. The Promoters' decision is final and no correspondence will be entered into.
  6. In the event that, due to the acts or omissions of the winner, the Promoters are unable to deliver the prize to the winner, that winner will forfeit the prize and no substitute or alternative will be available and a substitute winner may be selected.
  7. The prize is subject to availability, non-transferable and no cash alternative will be given.
  8. Any entries not meeting the above criteria shall be invalid. The Promoters will not be liable for any entries which are corrupted or not received for any reason.
  9. The winner agrees not to sell, offer to sell or use the prize for any commercial or promotional purpose (including, without limitation, placing the prize on an internet auction site)
  10. By entering, you agree that if you are chosen as a prize winner you will allow the Promoters to use your name, and photograph for their publicity and news purposes during this and any future promotions or advertising.
  11. The Promoters reserve the right to change, alter or withdraw the competition at any time.
  12. To the maximum extent permitted by the law, the Promoters shall not be liable for any claims or actions of any kind whatsoever for damages or losses to persons and property which may be sustained in connection with the receipt, ownership and/or use of the prize.
  13. If any of these terms and conditions are found by a competent court or other competent authority to be void or unenforceable, that term or condition shall be deemed to be deleted and the remaining terms and conditions shall continue in full force and effect.
  14. These terms and conditions shall be governed and construed in accordance with the laws of England and Wales. Any dispute arising is subject to the exclusive jurisdiction of the courts of England and Wales.

If any terms shall be unlawful, void or for any reason unenforceable then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

We will try to resolve any disputes with you quickly and efficiently. If you are unhappy with the goods, our service to you or any other matter, please contact us as soon as possible.

If after our customer service team has investigated your complaint, it has not been resolved, you may refer the dispute to an Alternative Dispute Resolution (ADR) provider. ADR is a process where an independent body considers the facts of a dispute and seeks to resolve it, without you having to go to court. While we are not a member of any ADR scheme, an example of an ADR provider which you could choose is The Retail Ombudsman. These terms are governed by English law and (without affecting your other rights and remedies for example, in relation to ADR as explained above) you can bring legal proceedings in respect of the goods or these terms and conditions in the English courts. If you live in Scotland, you can bring legal proceedings in respect of the products or these terms and conditions in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in respect of the products or these terms and conditions in either the Northern Irish or the English courts. These terms and conditions set out the entire agreement between you and us in respect of the sale, purchase and use of the goods and the website. They supersede any previous agreement or understanding in relation to the subject matter hereof. They may only be varied where separately agreed in writing between you and us.

BROOKS PRODUCTS

ADDITIONAL TERMS APPLY

The following additional terms and conditions apply when you purchase Brooks branded products via the SportsShoes website. This is because, the way in which we handle Brooks products differs to the way in which we sell the other products and brands which we make available via our website.

Brooks means Brooks Sports B.V. a company incorporated and registered in the Netherlands with Dutch Chamber of Commerce Registration Number 59935472 whose registered office is at Olympisch Stadion 33, 1076 DE Amsterdam.

ABOUT THE SUPPLY OF BROOKS PRODUCTS

The domain for the Brooks products is www.sportsshoes.com/products/brooks.

Where we sell Brooks products, we:

  1. Market the Brooks products on our website on behalf of Brooks.
  2. Deal with communications with you about your Brooks order, including sending you email order confirmation.
  3. Handle the payments you make for Brooks products and receive and administer those payments on behalf of Brooks.
  4. We may also undertake credit checks where relevant in dealing with those payment arrangements.
  5. Handle Brooks products returns on behalf of Brooks and deal with any after sales questions or issues you might have.

Please note that in accordance with our arrangement with Brooks, SportsShoes is not an agent of Brooks and does not have the authority to bind Brooks in any way.

DELIVERY FROM BROOKS

We do not at any point in the transaction, own any Brooks products and therefore, Brooks products which you buy will be sold by Brooks to you and are dispatched to you directly from Brooks. This means that when the Brooks products are delivered to you, they will arrive in Brooks rather than Sportsshoes packaging and Brooks will be responsible for the delivery of your products to you.

However, any delivery problems, returns and other customer service issues will be dealt with by SportsShoes on behalf of Brooks. That means that you should contact SportsShoes to deal with any such matters.

CANCELLATION RIGHTS

If you wish to cancel your contract for any Brooks products and exercise your cooling off right in order to receive a refund. All instructions in relation to your cancellation rights as explained above, will apply.

We will handle all cancellation of Brooks products on behalf of Brooks. Therefore, even though Brooks products are delivered to you directly from Brooks, if you wish to cancel the contract in accordance with these terms and conditions or send them back for any other reason, for example if damaged, please contact us rather than Brooks.

CHANGES TO THE RANGE OF BROOKS PRODUCTS

Brooks has the right to determine which of its products it wishes to make available for sale via the SportsShoes platform and so we cannot give any guarantee that any particular product range will continue to be available for any given period of time.

YOUR PERSONAL DATA - TRANSFER TO BROOKS

The personal data which you provide to us is dealt with in accordance with our Privacy Policy which you can access here. That also sets out important information about our use of personal data for marketing purposes.

In order for Brooks to deliver the products you purchase to you, we will need to transfer to Brooks, your personal data to it in order for your product to be dispatched. This will include your name and mailing address, telephone number, unique order number and order items. The relevant Brooks entity which will receive that personal data is Brooks Sports B.V. incorporated and registered in the Netherlands with Dutch Chamber of Commerce Registration Number 59935472 whose registered office is at Olympisch Stadion 33, 1076 DE Amsterdam, The Netherlands. We have a contract in place with Brooks which sets out the data protection obligations of the parties.

We provide this data to Brooks as it is necessary to allow the proper performance of your contract with us and in order to allow your products to be delivered to you.

Brooks may also retain your personal data for as long as it is properly required and may also transfer it to relevant third parties such as any permitted successors and assignees and may also need to transfer that data to its own delivery service providers and couriers.

Brooks will not use your personal data which we supply to it, for its own marketing or other purposes and will use the data only to despatch and deliver your order. SportsShoes however, may use your personal data for marketing of its own products and services from time to time but will only do so in accordance with our Privacy Policy.
